Francis Jutland conductor, being duly sworn saith that in company of constable Cummerford between the hours of 12 & one o'clock on Tuesday morning last he saw George Marshall cutting the ropes of Thomas Cooper's flagstaff on the Rocks. The prisoners were standing under the flagstaff and on Deponent going up they made their escape. Deponent secured Marshall and returned to find Wm. Walsh and George Allen and on arriving in Gloucester Street near the Prisoner Wm. Walsh's house he fell in with both prisoners and immediately laid hold of Walsh who was instantly rescued from Deponent by the prisoner George Allen on which Walsh directly ran into his house and soon after came out quite naked and with a large stone in his hand threatened to knock Deponent's brains out. The prisoner George Allen also took up stones and threatened to knock Deponent on the head & both prisoners said they would cut his (bloody) bowels and would be revenged of Deponent at some time or other. From the resolute and determined appearance of the prisoners who continued their abuse in the street for upwards of half an hour the whole of which time the prisoner Walsh was naked and from their horrid imprecations of threatening to take Deponent's life, Deponent refrained, thro' apprehensions they would carry out their threats into effect, to take them into custody & preferred making a report of their outrageous riotous and infamous conduct to the Bench and now verily believes his life to be in danger from both of the prisoners - they were both very drunk.

Deponent James Cummerford, constable, being duly sworn saith that on Tuesday morning last in company of Francis Jutland, conductor between the hours of 12 & one o'clock he saw a man named George Marshall on the flagstaff of the Cooper on the Rocks and was cutting the rigging through. The prisoners Wm. Walsh and George Allen were under the flagstaff and on Deponents going up to them they ran away after Marshall was secured in the watch house. Jutland & Deponent went in search of the prisoners & found them near Walsh's house. Jutland seized Walsh who was instantly rescued by the prisoner George Allen and he (Walsh) ran into his own house and shortly after came out quite naked and with a stone in each hand threatened to knock Jutland's brains out. Both prisoners said they would be revenged and "would cut Jutland's bloody guts out". They continued their outrageous riotous and diabolical threatening upwards of half an hour all of which time they were in the street and the prisoner Walsh was naked. From both prisoners having large stones in their hands & threatening with the same to knock Deponent's as well as Jutland's or any other constable's brains out conduced Jutland that they should leave the prisoners Wm. Walsh and George Allen where they were and report the proceedings to the Bench in the morning.
