"Smuggling at Tain. --In a Justice of peace Court at Tain yesterday, Archibald Wilson, senior, shepherd, Badvoon Kincardine was charged with a contravention of the Act 7 and 8 George IV., chap.53, section 32, by being concerned, on 14th August last, in concealing a quantity of spirits, the duty on which had not been paid. Mr Poole, supervisor of Inland Revenue, prosecuted. The defendant pleaded not guilty. From the evidence it appeared that on the date libelled, in a search made by Mr Poole, a large quantity of malt was discovered in defender's premises, as well as a properly constructed malting floor and two brewing thermometers. Beneath a bed in a garret five bottles of whisky were found concealed. Defender was not at home, and his wife, who was greatly agitated, stated that the find was the product of the first brewing, and that she had been against it from the first. A promise was made, if the case was not pressed, that the still would be given up, but it had not been discovered. For the defence it was attempted to show that defender was in the habit of getting bottles of whisky from a son in Edinburgh and others. The Justices unanimously found the charge proved, and sentenced Wilson to pay a modified penalty of 10 pounds, or suffer two months imprisonment"
